PRIVACY
My
Mothers Attic, mymothersattic.ca and 555 Lancaster Holdings Inc., holds your privacy in great regard. Therefore, in order to make
your Internet purchase as safe and secure as possible, we have installed the
latest encryption technology available. You may be assured that all your
information is encoded and unreadable as it is transmitted from your location to
our server. Our client data is stored on a database that is secured behind our
internal security systems not connected to the Internet.
We
have the utmost confidence in our secure server, however as technology is ever
changing, we will ensure that we upgrade our system accordingly as new industry
standards evolve.
Any
individuals or parties purchasing or attempting to purchase
products by fraudulent means of payment or the unauthorized use of Credit
cards will be prosecuted to the fullest extent of the law.
PAYMENTS
We
accept only Visa and Mastercard for purchases at this time and you must be of
legal age to make such purchases. If you are a minor under the age of majority
and wish to purchase, a parent or legal guardian must make such purchase for
you.
All
payments are submitted for off line approval and when your transaction is
approved, we will either e-mail or fax a completed invoice to you, indicating
the items you have purchased including all applicable taxes and shipping
charges, the approval number of your credit card transaction and all other
personal information provided in your electronic order. You
will be responsible for all taxes, duties, tariffs, and brokerage fees on orders
shipped outside Canada. All shipping is at the expense of the customer. This confirming billing
will be forwarded to you no later than one week, or less, from your order entry
date. We reserve full title to all goods until the payment transaction cycle is
complete and approved. All pricing and sales are transacted in Canadian Dollars.
RETURNS
All
of our products are packed and shipped with great care and in the condition that
is specified on our web site, most in original containers or presentation cases
where applicable. This care and attention ensures our goal of completely
satisfying your purchase. We therefore do not
accept
returns and consider all sales to be final after
payment approval. In the case of visible damage by carrier, your claim for any
and all damage should be directed to them. We currently ship exclusively by UPS
and have complete confidence that they will give your product the attention it
deserves. This also allows us to track the parcel to your door and obtain the
appropriate acceptance signature(s), as well as making Internet tracking
available to the client.
LIABILITY

accept any liability for loss of any kind by the purchaser or any other
individual, whether direct,
indirect, consequential, punitive or otherwise, as a result of transacting
business with the company via our website or directly through any employee,
officer, director or agent of the corporation.
LIABILITY
LIMITATION

Mothers Attic, mymothersattic.ca and/or 555 Lancaster Holdings Inc. total
liability to the purchaser or any other individual for any claims,
obligations, costs, damages or any other charges, whether under contract, law,
or theory of law, shall not exceed the sum of $1.00 CDN, regardless of any negligence or wrongdoing by My Mothers Attic, mymotherattic.ca and/or
555 Lancaster Holdings or any of their respective employees, officers, directors
or agents.
RELEASE
The purchaser or any other person(s) hereby release and
forever discharge My Mothers Attic, mymothersattic.ca and/or 555 Lancaster
Holdings Inc., their employees, officers, directors and agents from all rights,
claims, demands, complaints, proceedings, liabilities, obligations, legal fees,
costs or disbursements of all natures whatsoever, arising presently, in the past
or future, known or unknown, relating to any transaction with any of the
aforementioned companies or individuals.
INDEMNITY
The
purchaser and all others agree to indemnify and hold harmless My Mothers Attic,
mymothersattic.ca, 555 Lancaster Holdings Inc. and all of their respective
employees, officers, directors, agents, suppliers
et al, from and against any liabilities, costs and expenses including legal fees
and expenses incurred by the indemnified parties in connection with any claim or
demand arising out of the use of the website or in any transaction with the
aforementioned parties. The purchaser agrees to assist the indemnified parties
as reasonably as possible in the defence of any such claims or demands.
